피고인은 2018. 9. 3. 21:25경 서울 노원구 B 앞 길에서 주차 문제로 다툼이 있어 왔던 피해자 C(47세)이 피고인의 요청으로 자동차를 이동하여 주차하면서 불만을 표시한 것에 화가 나 손에 소주병을 들고 피해자에게 다가가며 “씨발새끼야, 너 여기에 차 대지 말라고 했는데 왜 댔어, 개새끼야, 너 오늘 한 번 죽어봐”라고 말하고 피해자의 앞쪽 땅바닥에 위 소주병을 집어던지고 “너 오늘 잘 걸렸어, 죽여버리겠다”라는 등의 말을 하여 피해자에게 어떠한 위해를 가할 것처럼 행세하여 협박하였다.
