피고인은 2013. 4. 10. 04:35경 수원시 팔달구 B에 있는 C편의점 내에서 피해자 D(24세, 여)가 있는 계산대로 다가와 아무런 이유 없이 “넌 뚱뚱하고 난 날씬한데 그게 문제다.”라고 말하는 것을 피해자가 무시하자 갑자기 계산대 출입문을 강제로 밀고 들어가 “이 씨발 년아! 좆같은 년아! 사람 말 무시하냐!”라고 욕설을 하고 피해자의 어깨를 3회 잡아당기는 등 위력으로 피해자의 정당한 업무를 방해하였다.
