Reasons
Punishment of the crime
The defendant is between the victim C and her husband D and neighbors, and the defendant used the above C and D's credit cards or check cards with the consent of the above victims because of economic difficulties while making clothes in the vicinity of the Seoul Jung-gu E, Seoul, with the consent of the above victims, and then proposed the payment to be transferred to the passbook in the name of the victims, and the victims consented to the proposal of the defendant.
1. The Defendant committed a crime against the victim C around February 2013, the Defendant issued a false statement that the said victim “inasmuch as he/she is a person with bad credit standing.” On the face of a week with a card issued under his/her name, he/she would transfer the amount of the accident card to the account that the amount of the accident card was missing.”
However, in fact, the defendant, as a person with bad credit standing, had only clothes funerals around May 2013, and the defendant's husband did not have any intention or ability to pay the card even if he had only his husband's workplace.
Accordingly, the Defendant: (a) by deceiving the said victim; and (b) using the Samsung Card in the name of the said victim from May 3, 2013 to May 3, 2013, the amount equivalent to KRW 196,180,000, the Defendant acquired financial benefits equivalent to KRW 19,758,158, by using the credit card in the name of the said victim from February 2, 2013 to August 2013, as indicated in the list of crimes; and (c) not paying KRW 19,758,158.
2. Crimes against victims D;
A. A. Around May 2013, the Defendant made a false statement to the victim D, who is the husband of Dongdaemun-gu Seoul Metropolitan Government, Dongdaemun-gu, that “The payment of the card must be avoided. When issuing the card under one’s name, the Defendant is responsible for and remitted the payment amount.”
However, in fact, the defendant, as a person of bad credit standing, had only clothes funerals around May 2013, and the husband of the defendant.
