Reasons
Punishment of the crime
[Defendant C] On January 31, 2013, the District Court sentenced Defendant C to two years of suspension of eight months of imprisonment for the crime of violating the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc., and became final and conclusive on April 23, 2013.
[Defendant C] From November 17, 201 to November 201, 2013, Defendant C operated “G”, a commercial entertainment business establishment located in F and C from the Government City from November 17, 2011, and Defendant A received and operated the said “G” from Defendant C from November 2013, and Defendant B served as an employee of the said “G”.
1. The Defendants conspired to operate both the said “G” from November 2013 to April 30, 2014.
Defendant
Since October 7, 2013, Defendant A entered into a sublease contract with Defendant A to sublease “G” business establishment for one year, and made Defendant A use of “G” business establishment, and lent his/her own name. Defendant C used one bank account in the name of Defendant C related to the card terminal and card sales, and had Defendant C continuously assist in operating “G” business from time to time. Defendant A took over four rooms with “G” business establishment from Defendant C, and installed four rooms with seven guest rooms and bathing facilities with 120,000 won for commercial sex acts from many and unspecified male customers, and Defendant B received commercial sex acts from his/her calculated customers and gave guidance to Defendant B as customers.
Accordingly, the Defendants conspired to commit acts such as arranging sexual traffic for business purposes.
2. Defendant A, from November 2013 to April 30, 2014, at the school environmental sanitation and cleanup zone within 200 meters from I kindergartens located in the Gu’s government H from November 2013 to April 30, 2014, is a business establishment arranging sexual traffic as described in paragraph (1).
