Punishment of the crime

【Criminal Facts】

From 1996 to 196, the Defendant is the leader of the C fishing village fraternity comprised of approximately 300 residents of the Magsan-ri, Magsan-ri, Chungcheongnam-gun, Chungcheongnam-do, Chungcheongnam-do, and has been in charge of the management of the expenditure, such as dividends, etc. on revenue and financial resources from the joint piracy of the fishing village fraternity.

In order to prevent the Defendant from mixing his personal deposits with the financial management of the fishing village fraternity, the Defendant prepared a passbook that separately manages the funds of the fishing village fraternity.

However, the Defendant,

1. Withdrawal of KRW 53,00,000, out of KRW 62,653,700, which was kept in a post office D account in the name of the person himself/herself opened for the management of the funds of fishing village fraternities at a post office located in Tae-gun, Tae-gun, Chungcheongnam-gun, 2006, and embezzlement it for personal purposes by arbitrarily consuming it for personal purposes;

2. On March 6, 2007, the Seosan Fisheries Cooperatives (Establishment Point 373) located in Seosan also withdrawn KRW 64,902,910,000 out of the capital of the fishing village fraternity in the name of the person himself/herself, which was opened for the fund management of the fishing village fraternity E in the name of his/her own account, and used KRW 58,000,000 out of that amount as the dividend for the fraternity members, and embezzled it for the remaining amount of KRW 6,00,000,000 for personal use;

3. On March 19, 2008

by withdrawing 56,657,378 of the fishing village fraternity funds of 2007, which were kept in the account referred to in the same paragraph, and embling them by any discretionary means of consumption while mixing and storing with one’s own account;

4. On March 2, 2009, at the point of origin of the Republic of Korea, Chungcheongnam-do, Chungcheongnam-do, Chungcheongnam-do, AF. of one’s own name established to manage the capital of fishing village fraternities.
