A defendant shall be punished by imprisonment for two years.
The defendant shall compensate the applicant for damages of KRW 150 million.
Reasons
Punishment of the crime
1. The Defendant, while working as the office staff of the Victim C fishing Village fraternity located in Seopo-si from January 2012 to December 7, 2016, has been engaged in accounting affairs such as document management and cash receipt and disbursement of the said fishing village fraternity.
On November 29, 2013, the Defendant deposited KRW 10,020,973 in the office of the said fishing village fraternity to the account of the victim’s member of the fishing village fraternity, and embezzled KRW 150,267,701 in total by arbitrarily consuming KRW 50,000 in the same manner as attached Table 1 re-off from the date of the crime committed to December 7, 2016, when the Defendant deposited KRW 10,020,973 in the office of the said fishing village fraternity to the account of the victim’s member of the fishing village fraternity in the course of his/her business custody for the said victim’s fishing village fraternity, and then withdrawing the lease deposit by way of termination of the said account even during his/her business custody for the said victim’s fishing village fraternity.
2. Alteration of private documents and the uttering of private documents;
A. On January 2016, the Defendant had been in charge of accounting duties while working as the secretary of the C fishing village fraternity, and was willing to raise the balance of the fisheries cooperative account passbook (G) in the name of C fishing village fraternity in order to conceal the fact of embezzlement as the Defendant was subject to the investigation from the F of the audit of the said fishing village fraternity.
On January 2016, the Defendant stated the portion of “5” and “8” printed in the number of other bankbooks for the purpose of exercising at the C fishing village fraternity office located in Seopopoposi, Seopopopoposi, D as “15-06-04 on a transaction day, 57,007,820, 57,007,820, 57,007,820” in the contents of the said passbook as “15-06-04 on a transaction day, 58,007, 820, 58,07,820, 58,007,820” and added it to “a copy of the deposit transaction under the name of the C branch office in Suwonposi, which is a private document to prove the fact by copying it, as well as a copy of the deposit transaction under the name of the C branch office in the name of the C branch office in accordance with the attached Table 2.
