A defendant shall be punished by imprisonment for a term of one year and nine months.

Punishment of the crime

[criminal record] The Defendant was sentenced to three years of imprisonment for fraud, etc. at the Daejeon District Court on January 29, 2010, and was released on April 30, 2012 in the Daejeon Prison on parole on the execution of the sentence and on July 24, 2012.

【Criminal Facts】

After having been sentenced to imprisonment with labor due to an insurance fraud crime, etc., the Defendant committed an insurance fraud, etc., and caused economic difficulties while driving a taxi, etc., the Defendant was willing to obtain insurance proceeds by intentionally causing a traffic accident by following the following methods: (a) facing some body of a vehicle running a narrow road, such as a stringer, etc.; or (b) causing a sudden accident by driving a vehicle while driving the vehicle.

At around 10:00 on July 15, 2013, the Defendant driven a C Non-Stop car and driven it on the front road located in Daejeon Dong-gu, Daejeon, and caused a traffic accident by getting the back part of the F-top car at the top of the F-top vehicle, which was driven in the same direction and followed by the vehicle in front of the F-top vehicle in the same direction. On the same day, the Defendant got F to receive the insurance accident as if the said traffic accident occurred due to the driver’s negligence.

The Defendant, after deceiving the victim as such, received KRW 960,00 from the victim on July 17, 2013 under the pretext of agreement, and received KRW 960,00 from the victim on July 17, 2013, as shown in attached Table 1, from July 17, 2013 to November 4, 2014, received KRW 1,639,750 in total from the victim on the pretext of agreement or treatment expenses, or had the victim make payments, and acquired property or property benefits equivalent to the same amount. The Defendant also received from the victim on the same basis of five-three occasions from July 15, 2013 to June 26, 2015, as indicated in attached Table 47.
