A serving as the Director General of the E Union from February 2, 2005 to November 2007, a person who has overall control over the business planning, expenditure, management, etc. of various projects, such as sandbarbol ecosystem conservation movement, endangered birds conservation movement, international cooperation, ecological activities, etc. related to endangered birds, and Defendant B, from February 2003 to February 2004, after having gone through an executive secretary of the E Union G from March 2004 to served as an executive secretary of the E Union F from March 2008, and has been assisting Defendant A with the said duties.
1. Although Defendant B’s sole criminal conduct uses only for the purpose of “H business” as stated in the business plan or the amended business plan in accordance with the donation management regulations of the Korea Racing Association, the Defendant was willing to pay part of the project expenses related to “H business” as an item for employees’ benefits, etc.
On December 30, 2004, the Korean Racing Association received 250,000 million won from the Korean Racing Association in the bank account (Account Number: I) in the name of the victim E Union and kept it for the purpose of "H business" for the victim. A.
On January 11, 2005, the Defendant deposited KRW 100 million from the above bank account under the name of the E Union, and deposited KRW 28750,000 out of the above money in the account of the E Union’s National Federation account, which is an account in the name of the E Union and unrelated to the purpose of H business, and had the E Union employees pay it as remuneration, etc.
(2) Of the above money, 75 million won (the remaining amount 70,1250,000 won separate 3.7.5 million won) was deposited in the new bank account in the name of the Union (K).
