1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On May 8, 2008, the Plaintiff deposited the money from the Plaintiff’s new bank account (E) to KRW 142 million, and deposited the said money into the bank account (G) of the certified judicial scrivener F in charge of the establishment of D Co., Ltd. (hereinafter “D”), and the remitter’s name was Defendant B.
B. Defendant B’s National Agricultural Cooperative Federation account (H) and KRW 47 million was deposited on April 30, 2008, and KRW 11 million was deposited from the Plaintiff’s National Bank account (I) on May 6, 2008. The above loans amounted to KRW 47 million. The Plaintiff received a loan under Defendant B’s name on the security of the building located in J as the Plaintiff’s investment.
C. On May 8, 2008, Defendant B remitted KRW 58 million from its own National Agricultural Cooperative Federation’s account to the bank account of the F to the bank account of the F. D.
D on May 13, 2008, a total of KRW 200 million deposited into the F’s above account was established as capital.
E. On September 29, 2010, the Plaintiff deposited the amount of KRW 60 million from his new bank account, and KRW 200 million from his national bank account, respectively, to Defendant B’s new bank account (K).
F. D additionally increases the capital of KRW 70 million on September 30, 2010; the total number of outstanding shares is KRW 140,000; and all of the above shares is owned by Defendant B on the shareholder registry of D as common shares; Defendant C owns KRW 56,000; Defendant C owns KRW 7,000, L, and M respectively 38,50 shares.
[Ground of recognition] In the absence of dispute, Gap evidence Nos. 1 through 3, 5 through 7, Eul evidence Nos. 1 through 3, and 19 (including each number, if any), the head of the New Bank Chungcheong Finance Center, the head of the NAFF, the head of the NAFF, the head of the NAFF branch, the head of the NAFF, the fact-finding results of each fact-finding, and the purport of the whole pleadings.
2. The assertion and judgment
A. The summary of the Plaintiff’s assertion is that the Plaintiff is in substance a capital of KRW 700 million for the establishment and capital increase of D.
