1. The defendant is based on the completion of the prescriptive acquisition on May 31, 2009 with respect to Pyeongtaek-si B, ditch 5, the plaintiff.

1. Basic facts

A. The Plaintiff’s father, from around 1972 to around 1979, he purchased 60,000 square meters (20,000 square meters), which is a reclaimed land newly created by the Korea Agriculture Promotion Corporation, by performing a tide embankment construction work at the time from around 1972 to around 1979. The Plaintiff’s father purchased 1 4 square meters (10,296 square meters; hereinafter “the instant purchased forest”) of Pyeongtaek-si and 1 4 square meters of forest land (10,296 square meters; hereinafter “the instant purchased forest”) on September 21, 1972, and each of F forest and G answers adjacent thereto on December 17, 1984 and February 19, 1985.

B. On March 18, 197, part of the purchased forest of this case was expropriated into the Korea Agriculture Promotion Corporation for the purpose of a ditch, and the ownership transfer registration was completed in the name of the Korea Agriculture Promotion Corporation (hereinafter “Defendant”) on the ground of expropriation, with respect to the land of this case, the land of this case was divided into 9,521 square meters of H forest and 3 State forest and 5 State forest and 5 State forest and 9,521 square meters of H forest and 3 State forest and 5 State forest and 3 State forest and 5 State forest, which are part of the ditch (hereinafter “instant forest”).

C. On May 18, 1989, C obtained a forest damage permit on the 1,592 square meters of Pyeongtaek-si F and H forests, and thereafter, C constructed a farming house and warehouse (hereinafter “instant farming household, etc.”) on the ground of a part of 974 square meters in the attached land cadastral map in the attached Form No. 974 square meters of the said land and adjacent Pyeongtaek-si J (hereinafter “instant adjacent land”), among the said land and the adjacent land, and owned and managed the adjacent land by separating from the adjacent land, the part of 60 square meters in the attached land cadastral map in the attached Form No. 1 (hereinafter “instant adjacent land”).

As to the adjoining land of this case, registration of preservation of ownership in the name of the defendant was made on June 18, 1993 by Suwon District Court No. 32191, which was received on June 18, 1993

E. On September 14, 1993, the 6 m2,786m2 in Pyeongtaek-si H 9m2 (9,521m2) was divided into 2,786m2, Pyeongtaek-si and 6,735m2 in Pyeongtaek-si and 9m2, and Pyeongtaek-siK on the same day.
