피고 인은 위 주거지에서 피해자와 술을 마시던 중, 같은 날 02:50 경 피해자에게 ‘ 늦었으니 자고 가라’ 는 취지로 말하여 피해자를 방으로 데리고 간 후, 피해자가 이불 위에 눕자, 갑자기 피고인의 얼굴을 피해자의 얼굴에 들이밀며 키스하려 하고, 피해자가 이를 피하기 위해 얼굴을 이리저리 돌리며 ‘ 하지 말라’ 고 말하면서 이불을 들어 피고인의 얼굴을 밀치자, 양손으로 피해자의 양 손목을 잡고 혀로 피해자의 얼굴을 핥다가 피해자의 볼을 깨물고, 피해 자의 위에 올라 타 피해자의 가슴과 엉덩이를 수회 만져 피해자를 강제로 추행하고, 이로 인하여 피해자에게 약 4 주간의 치료가 필요한 볼의 표재성 손상 등을 입게 하였다.
