A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for a period of four years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is the president who operates the “D Private Teaching Institutes” in Masan-si C and 3, and the victims are students who have taken lessons at the said Private Teaching Institutes.

1. Violation of the Act on the Punishment, etc. of Sexual Crimes (Indecent act by force against a minor under the age of 13);

A. From around 09:00 on May 2013 to around 19:00, the Defendant committed an indecent act by force against the victim, such as: (a) in the school room of the pertinent private teaching institute; (b) having been asked by the victim E (M, 11 years old); (c) having been aware of the problem; and (d) having been able to commit an indecent act by taking advantage of any cresh in the school room; and (b) having caused the problem by taking advantage of the cresh without any cresh in the school room; and (c) having the victim’s buckbucks by inserting his hand into the bucker of the victim; and (d) having the buckbucks.

B. On July 2013, the Defendant: (a) found the victim E at the school room of the above private teaching institute on the following day; (b) tried to ask questions as above; (c) made the said victim E (the said victim E, 11 years of age; and (d) committed an indecent act by coercioning the victim by forcing him/herself to talk with the victim’s chest and bridge with his/her own hand; and (c) committed an indecent act by forcing him/her, such as taking charge of his/her her son.

피고인은 2015. 6. 7. 12:00 경부터 15:30 경 사이에 위 학원 강의실에서, 혼자 남아 그림을 그리고 있는 피해자 F( 여, 12세 )를 보고 욕정이 생겨 추행하기로 마음먹고, 피해자에게 다가가 피해자의 손을 툭툭 치면서 쭈그려 앉은 채 갑자기 자신의 성기를 피해 자의 다리 부위에 닿게 하고, 피해자가 이를 피해 다리를 빼자 2~3 회 같은 방법으로 성기를 피해 자의 다리 부위에 닿게 하는 등 피해자를 강제로 추행하였다.

2. Violation of the Act on the Protection of Children and Juveniles against Sexual Abuse;

A. On June 3, 2015, the Defendant: (a) around 18:40 on June 3, 2015, in the lecture room of the above private teaching institute, asked questions to the victim B (L, 13 years of age); and (b) in the lecture room to make an indecent act due to the desire to commit an indecent act.
