Reasons
Punishment of the crime
To the extent that it does not interfere with the defendants' exercise of their right to defense, including obvious clerical errors and errors, part of the facts charged or the list of annexed crimes was appropriately corrected.
On August 12, 2015, Defendant A was sentenced to a suspended sentence of ten months for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Daejeon District Court on the Aggravated Punishment, etc. of Specific Crimes. On November 13, 2015, the Daejeon District Court sentenced Defendant A to a suspended sentence of four months for a crime of violation of the Act on the Protection of Children and Juveniles against Sexual Abuse (mediation, etc.) at the Daejeon District Court on the Aggravated Punishment, etc. of the said suspended sentence and completed the execution of the said sentence on March 13, 2017, by the final judgment on April 7, 2016, respectively.

C around July 20, 2017, at one’s own house located in Daejeon Dong-gu M and 303, called the victim N (W, 19 years of age) to “a request to change the nursing because the body is good.” The victim N accepted the request and was living together at the defendant C’s house. Defendant A, Defendant B, and I resided together in the studio located in Daejeon-gu, Daejeon-gu, Daejeon, from April 2017 to July 2017, and came to live together with Defendant C’s house.
The Defendants conspired with I to make the victim N temporarily open the cell phone and to raise the living cost by receiving the cell phone from the victim N, and selling it to the mobile phone distributor. On August 23, 2017, when additional crimes were difficult due to opening too much of the victim N's cell phone, the Defendants solicited the victim N's victim P(n, 19 years of age) with I and J, leading the victim P to temporarily open the cell phone and let the victim P temporarily open the cell phone and sell it.
