1. The defendant, among the land in Busan-gun C, shall follow the annexed drawings No. 9, 10, 11, 12, 13, 14, 15, and 9 in sequence among the land in Busan-gun C.

1. Facts of recognition;

A. On September 2, 2009, Nonparty D concluded a first sales contract with the Plaintiff on September 2, 2009, that the Plaintiff would sell to KRW 79,000,000 of the Plaintiff’s land E, F, and G (hereinafter only parcel numbers for the convenience of description) for KRW 1/2 of the KRW 79,00.

At the time, D was not the owner of the above F and G land, but later D purchased and sold the shares.

B. D received the ownership of the said G land from H on June 21, 2011. On July 11, 2011, the said E-Y, which was owned by D on July 11, 201, was merged into the said G field 397 square meters and the said G field 145 square meters, and became 625 square meters prior to subdivision.

C. On October 7, 2011, D concluded a secondary sales contract with the purport to sell 433/625 shares of the said G G 625 square meters to the Plaintiff at KRW 79,00,000.

The Plaintiff already paid the purchase price to D at the time of the first sale contract, and completed the registration of ownership transfer on October 17, 201.

D around June 2012, around 2012, sold his/her co-ownership of 192/625 square meters and J forest 200 square meters to the Defendant in KRW 5,00,000,00 among the said G field 625 square meters. In the relevant sales contract, the terms and conditions of permission are stipulated in paragraph (3) of the special terms and conditions of permission at the time of construction of the building (the inside part) in the said sales contract.

On July 2, 2012, J was divided into K, and K was converted into 215 square meters of C forest land on July 5, 2012.

F. Of the foregoing G field 625 square meters, 192 square meters was divided into L on July 16, 2012, and the F field 437 square meters was combined with F field 245 square meters on August 1, 2012. As to this, the registration of ownership transfer was completed in the Defendant’s name on July 3, 2012 due to the sale as of July 2, 2012.

In addition, the registration of ownership transfer was completed on July 11, 2012 due to the sale on June 22, 2012.

G. On July 17, 2012, the Plaintiff and D entered into an agreement on the division of the jointly owned property with the remaining 192 square meters owned by D, and on the same day, with respect to G 433 square meters on the same day.
