The defendant's appeal is dismissed.
Reasons
1. The gist of the grounds for appeal is that the Defendant, with the consent of D Co., Ltd. (hereinafter “D”), prepared the instant transfer certificate with the purport that D transfers the right to obtain a patent for a portable type emergency leading device (hereinafter “portable emergency leading device”) to the Defendant, and does not constitute a forgery and use of the transfer certificate.
2. The following circumstances acknowledged by the court below's decision and the court below's duly adopted and examined the evidence, i.e., F, the managing director of D, was consistently required from the investigative agency to the court of the trial, and the Defendant sent a blank with the corporate seal affixed to the application form, application form for corporate registration, certificate of corporate seal imprint, corporate seal imprint, etc. on October 6, 2010, and the Defendant merely demanded to send the blank with the corporate seal affixed to it. In relation to the transfer of the right to obtain a patent for a portable emergency leading device, the Defendant made a statement to the effect that there is no need to write the corporate seal affixed to the blank, and there is no reason to suspect the credibility of the above statement in light of F's statement attitude or statement. In light of the above circumstances, F, upon receipt of a request from the Defendant to change the patent applicant of the portable emergency leading device filed jointly with the Defendant, F, upon receipt of a request from the Defendant to the company's e-mail, signed and sealed the application form related to D, which is a corporate police applicant.
