1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. The Plaintiff’s attached C reported the sales advertisement of the “E” project published in D border newspapers, and sought the business explanation from F, an employee of the sales agency, and deposited KRW 1 million with the subscription money into the account indicated in the above newspaper advertisement on the 10th of the same month.
B. Since then, C visited the site of the Jeju Construction with an employee of the sales agency, and concluded a sales contract with the Plaintiff on behalf of the Plaintiff on November 17, 2015 (hereinafter “instant sales contract”) on behalf of the said employee, and paid 3,2750,000 won, excluding the down payment of KRW 1,000,000,000,000,000,000 won, out of the down payment of KRW 3,375,00,000,000,000
C. At the time, the above advertising for sale and the sale-to-sale guide car is indicated as follows: (1) the executor is named as the “StateG” or “G”; and (2) the sales contract of this case includes the seller’s entry as the “G” or “StateG”, and the deposit account holder of the sale-to-State deposit account as the “State G”. The address, representative, and business number indicated in the seller’s column are as indicated in the seller’s column. The stamp image of the corporate seal affixed on the seller’s column is written as “B Co., Ltd.”; and (3) in the receipt received by C with the down payment of the down payment as above, the “StateB” is written as the receiver and the corporate seal affixed on the seller’s column is affixed.
C On November 18, 2015, a text message was sent to the employee of the sales agency who entered into the instant sales contract, to the effect that “the name of the contract and the receipt is different, so the name of the company will be sent.” On November 19, 2015, a contract was entered into between the Defendant and the company with no legal entity, and the method of paying down payment differs from the method and method of the contract, and the area of the contract was merely the sales advertisement and the area.
