A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] On December 11, 2012, the Defendant was punished by a fine of 1.5 million won for a violation of the Road Traffic Act at the Gwangju District Court on December 11, 2012, and the same court on July 28, 2015 notified of each summary order of a fine of 2 million won for the same crime, and the same criminal records are three times.

[Criminal facts]

1. On July 21, 2017, at around 21:50, the Defendant without a driver’s license, driven a 1.5 km car in the name of the Defendant’s wife, a approximately KRW 1 km from the 24th street of Gwangju-dong to the 66th road in the center of Nam-gu, Gwangju-gu, Gwangju-gu, about 23:30 on the same day, a approximately 66 km from the center of Nam-gu to the front road of the Gwangju-dong 21-1, and around 02:40m on the following day from the Do located in the Seo-gu, Seo-gu, Gwangju-gu to the 500m street parking lot in the H.

Accordingly, the defendant has driven a motor vehicle without obtaining a driver's license over three times.

2. On July 22, 2017, the Defendant driving without a license and driving under the influence of alcohol at least 0.102% during blood while under the influence of alcohol without obtaining a driver’s license on July 22, 2017, the Defendant driving the said car at approximately 2 km from the Seo-gu Seoul Seo-gu J market to the Lel parking lot located in Dong-gu K.

As a result, even though the defendant had a record of driving a drinking motor vehicle at least twice, he/she once drives a motor vehicle without obtaining a driver's license in the state of being drunk with alcohol concentration of 0.102%.

3. Violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes by Abuse of Occupational Authority, etc.) the Defendant parked in the Iel parking lot located in Seo-gu in Gwangju, Gwangju on July 22, 2017, the Defendant rhumbbbbbbbs, side gate, and head of the victim’s hand even though the Defendant’s hand, who is the employee of the victim (the 19 years old), was humbbs of the victim’s hand in his/her own car in his/her own car in the above Aurdi vehicle located in Seo-gu, Gwangju, Seo-gu. On the same day, around 03:10 on the same day, the Defendant dumbs of the victim’s hand.
