A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant would purchase an article, which is the site of mediating the sale of game items, etc., to a person who has posted a letter on the part of the defendant's writing selling an item, on the part of the unit.
By false means, E received an item delivery, and E re-transfered it to another person, and conspired with E to distribute cash, after which it is cashed.
The Defendant stated in the bill of indictment around June 25, 2016 that “.........” but this appears to be obvious that it is a clerical error, and even if it is corrected without modification to the indictment, it does not seem to cause substantial disadvantage to the Defendant’s exercise of his/her right of defense. Thus, it is corrected ex officio as above.
In the trade PC room located in Jung-gu Seoul Central Government, Jung-gu, Seoul, there was a false statement that the victim F would sell a swimming pool, such as an item flab, at the above item unit site, and the victim would pay KRW 1,500,000 to B when selling an item to B.
However, even if the defendant received the above game items from the injured party, he did not have an intention or ability to pay the price to the injured party, only he thought that he would be commercialized by transferring them again.
On June 25, 2016, the Defendant, by deceiving the victim, obtained a total of 24,916,000 won as stated in the attached list of crimes, including the acquisition of pecuniary benefits equivalent to the same amount by not paying the price, after being issued a pool of 1,50,000 won (i.e., Rarar Lar Lar Lar Lar Lar Lar Lar Lar Lar Larb, etc.) from the victim of the damage.
Accordingly, the defendant conspireds with the victims to acquire economic benefits by deceiving them.
