A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2013. 10. 5. 21:40경 업무로써 혈중알콜농도 0.143%의 술에 취한 상태로 B 포터 화물차를 운전하여 구미시 원평동 삼성디지털프라자 앞 편도 2차로 중 1차로를 금오시장 쪽에서 구미역 방면으로 진행하던 중, 음주상태에서 전방주시의무를 태만히 한 채 운전한 업무상 과실로 같은 차로 전방에서 신호대기 중이던 피해자 C(28세) 운전의 D 마르샤 승용차 뒷 범퍼 부분을 위 포터 앞 범퍼 부분으로 추돌하여 그 충격으로 위 마르샤 승용차가 앞으로 튕겨나가 그 앞에서 정차 중이던 피해자 E(46세) 운전의 F 테라칸 승용차의 뒷 범퍼 부분을 위 마르샤 승용차의 앞 범퍼 부분으로 추돌하게 하였다.
