A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, who is a one-time employee of B, was dispatched to the work site of Sejong River D river project performed in C and worked as the working party, and obtained confirmation from E, who is the site manager of C, by entering the names and daily allowances of persons who have participated in the above work in the work in the preceding table, and received money from B, excluding the daily fees, which the Defendant received from C, after delivery of the preceding table to C and B.
The Defendant, who did not proceed with the work as much as the personnel expenses paid from the above E, was instructed by the Defendant and F that he would not claim the personnel expenses in the name of the Defendant and F, and was willing to arbitrarily prepare a list containing the Defendant and F and submit it to B.
1. On November 1, 2018, the Defendant forged private documents: (a) indicated “A 250,000” and “F 160,000” on the paper of the sheet that the Defendant had been in custody of the vehicle at GSM5, operated by the Defendant, using a pen, and written “E” voluntarily in the confirmation column; and (b) written the slips at will from the above date to January 26, 2019 to the above date and time to January 26, 2019; and (c) written the slips at will as “E” in the confirmation column.
Accordingly, the defendant, for the purpose of exercising a certificate of fact, forged Chapter 80 of the preceding Table in the name of E, which is a private document of fact certification.
2. The Defendant at the time of uttering of the above investigation document submitted to the said I, who is aware of the forgery at the B office operated by the said I located in Daejeon Daejeon-gu, Daejeon-gu, as described in paragraph (1), one of the forged slips was submitted as if they were duly constituted, and used each of the forged slips was submitted from the above date to January 26, 2019, respectively.
3. The criminal defendant has a legitimate authority to claim personnel expenses for the victim I operating B at the time and place specified in paragraph 2.
