A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
The suspect is a foreigner of Vietnam's nationality who entered the Republic of Korea as a non-professional employment (E-9-1) sojourn status on April 11, 2017 and the period of stay expires as of July 20, 2018.
1. On September 25, 2018, the Defendant, at around 07:31, Sept. 25, 2018, committed theft and intrusion on a structure, at around 07:31, 2018, the Defendant: (a) removed the correction device by means of cutting off the power connected with the automatic lock locked license using a hack machine from the surrounding area; (b) opened the said automatic door by hand and intruded into it; and (c) cut off three cellular phones (Aop X) with a market price of at least one million won, which is the market price owned by the victim located in the display stand.
2. On October 1, 2018, the Defendant: (a) invaded upon a thief and structure at the same place as around 06:41, Oct. 1, 2018; (b) in the same manner as paragraph 1; and (c) in the same manner as paragraph 1; and (d) stolen three mobile phones (i.e., a victim C’s market price) worth KRW 1 million.
3. In the same place as around October 21, 2018, the Defendant: (a) intruded into the said store and stolen mobile phones; (b) attempted to open the door after automatically locked the phone, such as paragraph (1), but the victim C, who was installed in the inside and outside of the store by means of a correction device installed by the victim C; (c) destroyed the device of KRW 380,000,000 in the market price by putting the device attached to the door, thereby destroying the device; and (d) failed to intrude into the store because the door was not opened.
4. On October 16, 2018, at night, the Defendant: (a) at the same place as around 02:40 on October 16, 2018 at night; (b) at around 02:40 on October 16, 2018, the Defendant: (c) opened the corrected windows in a hand-to-faced and intrudes into the store; and (d) KRW 57,000 in cash owned by the victim C; (b) the amount of KRW 1 million in the market price owned by the victim in the display stand; and (c) the amount of KRW 8,00,000 in an amount of KRW 8,00,000 in the market price, which is equivalent to KRW 8,000,000 in the phone X; and (d) the market price.
