1. As to the area of 295 square meters prior to K in Jung-gu Incheon Metropolitan City:
A. Defendant I: (a) The Plaintiff G out of the 1,322/37,761 shares in the above land.
Reasons
1. Basic facts
A. The Plaintiff A, G, H, and deceased on December 23, 2017 (the network B succeeded to its status as Plaintiff C, children, and Plaintiff D, E, and F, the wife of which died on December 23, 2017, and 37 persons, including the Defendants, were co-owned as shares in the “contractor’s share of land before subdivision” in the attached Table 1 B.
B. The remaining co-owners, other than the Defendant Incheon Metropolitan City, selected N, etc. as a representative from around 2002 to promote the subdivision of the land before subdivision. At around 2006, N et al., divided the land before subdivision into 45 parcels and divided into 43 parcels of land before subdivision into 45 parcels of land, and the remaining two parcels of land shall be the road, but the remaining two parcels of land shall be the road, and persons holding the remaining land except the land that has already been secured for entry, adjacent to the office of Jung-gu Incheon Metropolitan City, which is the existing road located at the upper end of the land before subdivision, collect some area and draw up an agreement to the same effect as the attached Form 2 drawing containing the content of covering the road area (hereinafter “instant drawing”).
C. N. N. and nine others added a clause that does not impose civil or criminal liability on the representatives who performed the division (hereinafter “instant exemption clause”) in the agreement in question, even if there is a somewhat different difference between the instant drawing and the cadastral map in the agreement in question. They received the seal from all co-owners, other than the Defendant Incheon Metropolitan City, to the effect that they consent to the said agreement.
As a result of the survey, N, etc. appears to have expanded the total area of 295 square meters in Jung-gu, Incheon (hereinafter “instant road1”) and 3,421 square meters in total (hereinafter “instant road2”) prior to K, Jung-gu, Incheon, which is a actual road, compared to 301 square meters and 3,377 square meters indicated in the instant drawing.
