A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

around July 2006, the defendant is a person of Vietnam who married with his husband who was married with his husband in Korea and was naturalizationed in Korea.

Where a foreign country falls under "the country recognized as a domestic license" among those who have obtained a driver's license that has been registered as a resident from among those who have been issued by a foreign competent agency pursuant to Article 84 (1) 3 and (2) of the Road Traffic Act, such foreign country may file an application for the exchange of a Korean driver's license with the local police agency by submitting documents, such as the original and original passport, etc.,

1. On January 2016, the Defendant: (a) requested the forgery of a Vietnamn Driver’s License in the name of the Office in charge of the transportation of Vietnam, which is a part of the documents required for the issuance of a Korean driver’s license, in return for providing KRW 800,000,00 to “B”, a hub for arranging the forgery of the Vietnamn Driver’s License for the purpose of uttering; and (b) forged a copy of the Vietnamn Driver’s License in an unsound manner.

Accordingly, for the purpose of exercising a certificate jointly with B, the Defendant forged one copy of Vietnam's driver's license under the name of the Office in charge of Transportation in Vietnam, which is a private document on the certificate of fact.

2. On March 30, 2016, the Defendant: (a) exercised the Cheongju License Test at the Cheongju-si education center located in Cheongju-si, Hong-si; (b) as if the document was a document duly formed, the Defendant had the foreign driver’s license issued to the foreign person who is aware of the forgery, as described in paragraph (1).

3. The Defendant of the obstruction of performance of official duties by fraudulent means presented the dates, places, and documents necessary for the exchange with 1 Vietnamese Driver’s License and 1 Korean Driver’s License as described in paragraph 2, and caused the mistake, mistake, and site of a person in charge of issuing foreign licenses who knows that the forgery was forged, thereby causing the mistake, mistake, and site in the name of the Commissioner of the Chungcheong Police Agency.
