1. Basic facts

A. (O. 04.02.04) A reported that B would install waste-generating facilities to the Defendant on February 4, 1997 to the Defendant on the following, pursuant to Article 11(3) of the Act on the Management and Use of Livestock Excreta (hereinafter “the Livestock Excreta Act”), and Article 8 of the Enforcement Decree of the Livestock Excreta Act (hereinafter “the site of this case”), the Livestock Excreta Co., Ltd (hereinafter “the instant livestock shed”) established discharge facilities and disposal facilities under the Livestock Excreta Act (hereinafter “the instant livestock shed”), and the Defendant accepted the report.

B. (Approval B for the use of the instant stable on April 9, 1998) obtained from the Defendant on April 9, 1998 that the instant stable may be constructed on the instant building site. On April 10, 1998, the construction of the instant stable began on April 10, 1998, and obtained approval for the use of the instant stable on May 12, 1998.

(B) In 2002, B illegally constructed a stable on the instant land, a stable with a total floor area of 1,550.27 square meters was illegally newly constructed on the instant land.
