1. The Defendant’s KRW 397,002,00 as well as 5% per annum from April 24, 2016 to July 7, 2017 to the Plaintiff.

1. Basic facts

A. 1) The Defendant is a housing construction project that constructs apartment and auxiliary facilities, neighborhood living facilities, etc. in the Incheon City C Group (hereinafter “instant housing construction project”).

D Co., Ltd. (hereinafter referred to as “D”) around March 2014 to implement the plan.

B) As to the Defendant’s instant housing construction project, D’s so-called PM business services contract (hereinafter “instant prior contract”) with the content that D carries out the Defendant’s instant housing construction project funding business, the selection of a contractor, and the sale advertising business delegated by D.

Defendant and D conclude a contract. After that, Defendant and D, Inc. (hereinafter referred to as “E”), D and E collectively, are “D, etc.”

2) On April 15, 2015, the Plaintiff and the Defendant concluded a PMF service contract (hereinafter “instant contract”) with the content that the Plaintiff will succeed to the status of D, etc. under the said PMF service contract in order to have D jointly perform the PMF business, and the Plaintiff received KRW 500 million of the down payment under the instant contract from the Defendant on April 17, 2015.
