1. Basic facts

A. The Plaintiff is a company with the purpose of operating a private teaching institute business and lifelong educational facility business. The Defendant is a school foundation that operates C University, D Female High School, and Embs Secondary School. 2) Under the Act on Recognition, etc. of Credits (hereinafter “Recognition Act”), the F lifelong Education Institute affiliated with the Defendant C University (hereinafter “C University”) (hereinafter “C University”) may conduct the assessment and recognition as prescribed by Presidential Decree for the course of learning established and operated by lifelong educational establishments prescribed by Presidential Decree, vocational training institutions, etc. (Article 3(1) of the Act on Recognition of Credits), and the Minister of Education recognizes the credits equivalent to or higher than those of the persons who completed the course of learning (Article 7(1) of the same Act). The person who has obtained the recognition of certain credits is recognized as having the same academic background as or higher than that of the college under Article 2 subparag. 1 of the Higher Education Act or the junior college under Article 2 subparag. 4 of the same Act (Article 8(1) of the same Act). In addition, the head of a high school or a university may be recognized as meeting certain requirements under Article 7.

(Article 9) Accordingly, the course of study evaluated and recognized was used as a means of obtaining a degree from high school graduates.

The credit bank system bachelor's degree program (hereinafter referred to as "the credit bank system of this case") is established and operated.

B. Around 2005, G with a representative director of the Plaintiff, including the conclusion of the instant Work Support Agreement, proposed a business plan for operating the indoor design bank system course at the Social Education Institute affiliated with C University, which was evaluated and approved in accordance with the Act on Recognition of Credits, to the Social Education Institute affiliated with C University, a telegraph of the instant Lifelong Education Institute.
