피고인은 2019. 2. 19. 01:55경 경기 광명시 디지털로 5에 있는 광명경찰서 B팀 사무실에서 같은 날 무전취식하며 소란을 피운 혐의로 현행범체포되어 조사 대기석에서 대기하던 중 그곳에서 근무하던 위 경찰서 소속 경찰관인 C(47세)가 수갑을 채우자 피고인의 처와 딸 등이 듣고 있는 가운데 위 피해자에게 “야 임마 오자마자, 수갑 채운건 잘못됐자나, 야 빛나리 너는 내가 가만히 안둬, 야 이 씨발놈아 내가 강간을 했어 사람을 죽였어 씹새기는 내가 나와서 가만히 안둬, 빛나리는 내가 가만히 안놔둬”라고 말하여 공연히 피해자를 모욕하였다.
