1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The pertinent Plaintiff was newly appointed as a full-time lecturer at C University on March 1, 1991 (hereinafter “Defendant University”) and served as an assistant professor on October 1, 1993 and as an associate professor on October 1, 1999 and was promoted as an associate professor on October 1, 199 and thereafter in the social welfare administration division from March 1, 2008.

A retired person is the educational foundation that operates the Defendant University (hereinafter referred to as “Defendant Corporation”).

(b) A committee for examination on appointment of teachers whose retirement age is guaranteed shall be established to examine teachers employed by the retirement age limit under Article 39-4 of the relevant regulations, such as appointment of professors.

(2) The composition and operation of the committee for the examination on appointment of teachers whose retirement age is guaranteed, and persons eligible for employment of teachers whose retirement age is guaranteed, methods, examination standards, etc.

(3) Appointment of teachers eligible for retirement age security shall be made by the president upon the recommendation of the president and by a resolution of the board of directors on the recommendation of the teachers' personnel committee, after passing the examination.

The prescribed number of faculty members to be appointed by the retirement age limit under Article 39-5 shall not exceed 15 percent of the prescribed number of full-time faculty members.

In such cases, the president shall determine it upon approval by the board of directors.

The Personnel Committee for Teachers (hereinafter referred to as the "Personnel Committee") shall be established in order to deliberate on important matters concerning the personnel affairs of teachers (excluding the heads of schools) under Article 48 (Establishment of the Personnel Committee for Teachers and Staff).

Article 49 (Functions of Personnel Committee) (1) The Personnel Committee shall deliberate on the following:

1. Matters concerning consent when the head of a university educational institution intends to appoint or dismiss teachers. (1) Meetings of the personnel committee shall be convened by the chairperson when the head of the school so requests or when the chairperson deems it necessary;

(2) The personnel committee shall attend a majority of incumbent members and pass resolutions with concurrent votes.
