A defendant shall be punished by imprisonment for three years.

The defendant shall be ordered to complete a sexual assault treatment program for 40 hours.

Punishment of the crime

On October 23, 2013, the Defendant was sentenced to eight months of imprisonment with prison labor for an injury at the Chuncheon District Court, and completed the execution of the sentence on December 21, 2013.

As a result, the defendant suffered injury to the victim during a period of about four weeks, resulting in the loss of a baby (five to a baby) in need of treatment.

At around 16:00 on February 8, 2014, the Defendant, in combination with the Victim G (V) who had a flat inside of the instant “D” restaurant, performed the alcohol in a manner consistent with the said “D” restaurant, and became the victim’s house in Thailand C around 17:30 on the same day for a more time to drink with the victim.

피고인은 주방에서 안주를 만들고 있던 피해자를 강간하기로 마음먹고 피해자에게 “엄마 ,빨리 들어와 봐!”라고 재촉하여, 피해자가 방으로 들어오자 피해자의 몸을 양손으로 끌어안고 입을 강제로 맞춘 뒤 바지를 무릎 아래쪽까지 내리고 팬티를 벗기려고 하였으나 피해자가 몸을 밀쳐내는 등 거세게 반항하자, 화장대 옆에 꽂혀 있던 과도(길이 10~15cm 추정)를 들고 피해자의 좌측 옆구리와 콧등을 각 1회 찌르고 도주하였다.
