Punishment of the crime

[2014 Highest 3993] On August 26, 2014, the Defendant stolen the cash amounting to KRW 800,000,000 managed by the Defendant at the PC bank managed by the second victim D of the building C in Daejeon-dong, Daejeon-gu, Daejeon, by making use of the gap in the location of the victim, from the PC bank that was not locked by the victim.

1. On July 6, 2014, the Defendant cut off the victim’s 30,000 won at G S5 mobile phones in Samsung Gallon, the market price of which is equivalent to KRW 860,00,00,000, by taking advantage of the gap in which the victim’s H was drunk, in the G singing shop located in the F of Chungcheongnam-gun, Chungcheongnam-gun, the Defendant used the gap in which the victim’s H was drunkly drunk.

2. Fraud and violation of the Specialized Credit Finance Business Act;

A. On July 6, 2014, the Defendant, at the same place of operation of the victim’s name omitted, using a stolen national card, as seen above, carried out as if he/she was a legitimate holder, and settled 80,000 won of the drinking value, thereby acquiring economic benefits equivalent to that amount and using stolen credit cards.

B. At around 22:40 on the same day, the Defendant settled the drinking value of KRW 200,000 in the same manner at the same place, thereby acquiring economic benefits equivalent to the same amount and using stolen credit cards.

C. On July 7, 2014, the Defendant: (a) used the same national card at a place where the location is unknown; (b) paid KRW 39,360 of the taxi fee by using the victim’s name-free taxi; and (c) obtained economic benefits and used stolen credit cards.

The defendant, at around 01:40 on the same day, uses the same national card to pay 20,360 won of the taxi fee by paying 20,360 won after using the same passenger card at a place where no location is known.
