A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Even if the Defendant is not a person handling narcotics, the Defendant treated the marijuana as follows.
1. Around March 20, 2020, the Defendant purchased 30,000 won in cash from the hemp plant seeds in Dongdaemun-gu Seoul, and purchased approximately 1kg of the seeds of the hemp plant for the purpose of smoking by cutting off the hemp plant seed coats in Dongdaemun-gu, Seoul.
2. Smoking marijuana seed coats.
A. On March 20, 2020, the Defendant: (a) opened the hemp seeds purchased at the Defendant’s residence located in the Seoul Special Metropolitan City, Gwanak-gu D Building E, separated the hemp seeds from rode to rode; (b) cut the rode of the tobacco in its possession; (c) putting the rode of the tobacco in its possession at less than 0.2g to 0.3g of the hemp seed coats; and (d) smoked as smoking with a frosh.
B. On March 22, 2020, the Defendant smoked approximately 0.2g to 0.0.3g of marijuana seed coats at the places described in the second paragraph (a) at low time.
C. On March 24, 2020, the Defendant smoked approximately 0.2g to 0.0.3g of marijuana seed coats at the places described in the second paragraph (a) at low time.
On March 26, 2020, the Defendant smoked approximately 0.2g-0.3g of marijuana seed coats at the places described in the second paragraph (a) at low time.
E. On March 28, 2020, the Defendant smoked approximately 0.2g to 0.0.3g of marijuana seed coats at the places described in paragraph 2(a) at low time.
F. On April 1, 2020, the Defendant smoked approximately 0.2g to 0.0.3g of marijuana seed coats at the places described in Section 2(a) at the same time.
G. On April 3, 2020, the Defendant smoked approximately 0.2g to 0.0.3g of marijuana seed coats at the places described in the second paragraph (a) at low time.
H. On April 5, 2020, the Defendant smoked approximately 0.2g-0.3g of marijuana seed coats at the places described in the second paragraph (a) at low time.
