Punishment of the crime
1. Defendant A
A. A. Violation of the Assembly and Demonstration Act is a democratic labor union D with the entire country.
In order to continuously hold large-scale assemblies in the vicinity of the apartment construction site in Pyeongtaek-si, the Defendant thought to secure the location of employment of democratic union members in order to encourage them to pressure employment and eradicate illegal employment of foreign workers.
1) On March 9, 2017, the Defendant at the construction site of the E apartment, on March 2, 2017, ordered the F to report an assembly to the head of the Pyeongtaek-gu Police Station on the following: “F from March 6, 2017 to March 31, 2017,” “from March 6, 2017 to March 31, 2017, delivery of the fences at the construction site of Pyeongtaek-si E apartment; “an illegal discontinuance of employment;” and “an owner of the assembly and demonstration shall not engage in any act clearly deviating from the scope of the reported purpose, date, time, place, method, etc.
Nevertheless, on March 9, 2017, from around 14:00 to around 14:35, the Defendant sent to the head of the branch office who participated in the above assembly held on the street in front of the construction site of Pyeongtaek-si apartment construction site “Sae and Ra, along with members who participated in the assembly at the building site,” and delivered it to the members present at the above head of the branch office, the Defendant exceeded 1,000 persons who participated in the assembly at that time, and carried out the assembly report at the front of the internal office of the construction site of the apartment site of the apartment site of this case, not at the place where the assembly report was filed at the time, but at the front of the internal office of the construction site of this case.
