Defendant
A shall be punished by imprisonment with prison labor for ten months, and imprisonment with prison labor for six months.
, however, from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Defendant A is the head of the Daejeon District Office, Defendant B is the head of the Daejeon District Office, and Defendant B is the head of the Daejeon District Office.
2. Criminal facts;
A. On March 24, 2016, Defendant A instructed Defendant B to submit an assembly report stating the name of assembly, “E”, “F”, “delivery in front of the G University’s sentiments,” “V”, “Defendant A, the person in charge of liaison,” “Defendant A, the person in charge of liaison,” and “Defendant B and 30 persons,” and Defendant B submitted the assembly report as above upon receipt of the order.
2) Although Defendant A’s organizer was not allowed to engage in any conduct clearly deviating from the scope of the reported purpose, date, time, place, method, etc., Defendant A’s organizer, despite of the fact that Defendant A was the organizer of the assembly, who was going to hold an assembly before the delivery of the sentiments of G University located in Daejeon Seo-gu I from H 11:45 to the same day, Defendant A continued to hold the assembly, unlike the reported content, by moving the place to the front of J. within the boundary of the sentiments of G University.
As a result, Defendant A clearly exceeded the reported place as the organizer of the assembly, and convened the assembly.
3) Although Defendant B could not engage in any act clearly deviating from the scope of the reported purpose, date, time, place, method, etc., Defendant B participated in the assembly as described in the foregoing paragraph 2, Defendant B, despite being participating in the assembly as described in the foregoing paragraph, participated in the assembly by moving the place to a delivery front of J in the door of the G University, unlike the reported content.
As a result, Defendant B clearly exceeded the reported place as a person who maintains the order of the assembly.
B. Violation of the Punishment of Violences, etc. Act (Noncompliance with joint withdrawal) Defendant A, jointly with the non-name union members, is holding a meeting on the pretext of “L” in front of the headquarters of G University as stated in the above paragraph (a) at around 12:10 to 12:43.
