A. The Plaintiff attended both E and D middle school in 2019 and the second grade in 201.

B. On October 23, 2019, the Defendant: (a) taken measures against the Plaintiff for transfer under Article 17(1) Subparagraph 8 of the former Act on the Prevention and Countermeasures against School Violence (amended by Act No. 16441, Aug. 20, 2019; hereinafter “former School Violence Prevention Act”) on the ground that “the Plaintiff was aware of the fact that he/she threatened E with the C on October 1, 2019; (b) was identified by witnesses; and (c) was intended to cause injury to E with a deadly weapon; and (d) the intention of doing so is difficult to see that he/she was against it; (c) the transfer under Article 17(1) Subparagraph 8 of the former Act on the Prevention and Countermeasures against School Violence (amended by Act No. 16441, Aug. 20, 201; hereinafter “former School Violence Prevention Act”); (d) the prohibition of contact and retaliation against the reported and accuser; (e

(hereinafter referred to as “the instant disposition”) is limited to the Plaintiff’s dispute.

On December 3, 2019, the Plaintiff filed an application for reexamination with the Gyeonggi-do Mediation Committee of Disciplinary Punishment on Students, and the Gyeonggi-do Mediation Committee of Disciplinary Punishment on Students dismissed the Plaintiff’s request for reexamination.
