A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
"2019 Highest 197"
1. On May 15, 2018, the Defendant: (a) around 22:00 on May 15, 2018, committed the crime at “Oono shop operated by the injured party B, who was in the Chang-si Jin-si (hereinafter omitted)”; (b) the Defendant, despite the Defendant’s orders for alcohol, alcohol, etc., took place as if the Defendant would normally pay the price despite the absence of the intent or ability to pay the price; and (c) ordered the Defendant to provide the beer and the beer services.
As above, the Defendant did not pay 10,000 won and 10,000 won of the market value in the same place by deceiving the victim as above, and did not acquire the pecuniary benefits equivalent to the same amount due to the Defendant’s failure to pay it.
2. On October 12, 2018, the Defendant: (a) around 23:00 on October 12, 2018, at the main points operated by the victim as indicated in paragraph (1) of this Article, the Defendant placed an order for the service of beer and beer to the victim as if the Defendant would normally pay the price despite having no intention or ability to pay the price, even if he/she orders alcohol and beer, and ordered the service of beer and beer to the victim.
The Defendant, by deceiving the victim as above, did not pay the amount of money equivalent to 150,000 won, even though he was provided with beer and beer services equivalent to the total market value from the victim’s position, thereby acquiring property profits equivalent to that amount.

1. On October 24, 2018, around 01:40 on October 24, 2018, the Defendant ordered the victim’s service of beer and beer in the “sing shop” operated by the victim C, who was in Chang-si, Chang-si (hereinafter omitted) to pay the price, even if he/she orders alcohol and beer, he/she does not have an intent or ability to pay the price, and ordered the victim to pay the price in a normal manner.
As above, the Defendant, by deceiving the victim and being provided with 30,000 won with 110,000 won in total in the market value from the victim’s position, shall be acquired through deception and total sum of 60,00 won.
