A defendant shall be punished by imprisonment for two years.
590,000 won shall be additionally collected from the defendant.
Reasons
Punishment of the crime
Defendant is not a narcotics handler.
1. Medication of phiphones;
A. On November 26, 2015, the Defendant: (a) decided to meconc with the meconcule c (one philopon; hereinafter “philopon”) which is a local mental medicine, such as E, F, and G, in a meconcule room in which the name near the D Station C in Suwon-si, Suwon-si, Suwon-si, could not be known; (b) decided to meconcilate the meconcule; and (c) divided the meconculon into four meconculs in one meconcule and then injected it into E, F, G, and their own arms.
Accordingly, the Defendant, in collusion with E, F, and G, administered philophones.
B. On January 23, 2016, at around 18:00, the Defendant: (a) decided to administer phiphones like E, J, and F at the International Hostel room located in Bupyeong-gu Incheon Bupyeong-gu, Incheon; and (b) duplicating one eye into four for a single-use injection machine, and duplicating one eye into E, J, F, and their own arms.
Accordingly, the Defendant administered phiphones in collusion with E, J, and F.
2. Sale and purchase of phiphones;
A. On April 15, 2016, at around 21:30, the Defendant opened approximately KRW 0.35g of philopon from E in front of L elementary schools located in Bupyeong-gu Incheon Metropolitan Government, and remitted KRW 200,000 of the purchase price of philopon to the accounts of the Saemaul Treasury in the name of E at a place where around 0.35g of opon cannot be known.
B. On May 5, 2016, the Defendant: (a) 17:00 on May 5, 2016, in the vicinity of the Bupyeong-gu Incheon Bupyeong-gu apartment apartment site, 0.35g philopon from E to E; and (b) transferred KRW 190,000 to the Saemaul Treasury’s account in the name of E at a place where around 20:06 cannot be known.

On May 7, 2016, at around 14:00, the Defendant dried up approximately 0.35g philopon from E in the street of the Bupyeong-gu Incheon Bupyeong-gu apartment site, Incheon, and transferred KRW 200,000 of the purchase price of philopon to the accounts of the Saemaul Treasury in the name of E at a place where it is not known at around 16:52 on the same day.
Accordingly, the Defendant sold philophones three times.
