Reasons
Punishment of the crime
[criminal history] On June 23, 2016, the Defendant was sentenced to one year of imprisonment with prison labor by the Incheon District Court, and completed the execution of the sentence in the original prison on February 19, 2017.
[Criminal facts] 2017 Highest 5214
1. On May 6, 2017, at around 00:59, the Defendant: (a) went into the “D Schlage” located in Bupyeong-gu Incheon Metropolitan City, Bupyeong-gu, Incheon; (b) cut off, with one half of the market price equivalent to KRW 100,000,000 in the market price, where the said employee was kept in custody in the Kackter, by breaking the gap where the employee’s surveillance was neglected; and (c) cut off by using one copy of the Samsung Card owned by the victim, one corporate bank card, one bank card, one bank card, and one cash account.
2. On May 25, 2017, the Defendant: (a) around 20:12, the victim G management in Bupyeong-gu, Incheon, Bupyeong-gu, Incheon; (b) opened and intrudeed an exclusive entrance door for employees not corrected by the victim with a locking place; and (c) cut off with one cellphone in the amount equivalent to one million won of the market price owned by the victim on the part of the client at the place.
Accordingly, the defendant invadedd a structure at night and stolen the property.
3. Violation of Acts in financial business specializing in fraud and credit finance;
A. On May 6, 2017, around 01:10 on May 6, 2017, the Defendant purchased tobacco 1 of the amount equivalent to KRW 78,500 in the market price of KRW 20,00,00 from the “J” convenience store in Bupyeong-gu Incheon Metropolitan City’s Bupyeong-gu’s Bupyeong-gu operation of the victim’s name, and suggested that the victim was the Defendant’s card, as described in paragraph 1, and had the victim settle the payment with the above card.
Accordingly, the defendant used stolen credit cards and received property by deceiving the victim.
B. On May 6, 2017, the Defendant settled 330,000 won from the “M” of the victim L Management in Bupyeong-gu Incheon Metropolitan City, Bupyeong-gu, Incheon, under the influence of the alcohol value, and completed the Defendant’s Samsung Card in the name of E, as described in paragraph (1).
