Reasons
1. Determination as to the cause of claim
A. 1) The Plaintiff is a person engaged in stock investment advisory business in operating the Internet car page of NAV. 2) From September 24, 2016 to November 15, 2016, the Defendant connected D with the domestic issue debate room, etc. of the NAV bulletin board, and written up comments and posts that slander or insult the Plaintiff (hereinafter “each of the instant notices”) with the contents indicated in the attached list.
3) The Plaintiff filed a complaint against the Defendant by preparing each of the instant comments and insulting the Plaintiff. On May 26, 2017, the Defendant was issued a summary order of KRW 500,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000
B. According to the above facts of determination, the defendant is obliged to pay consolation money to the plaintiff as compensation for mental damage, since it is obvious in light of the empirical rule that the plaintiff engaged in stock investment advisory business would have suffered mental suffering due to the above tort committed by the defendant, since the defendant made a false statement to the purport that the plaintiff would have conducted an inappropriate stock investment advisory business in order to sell his own stocks at a high price, thereby undermining the plaintiff's reputation by impairing the social evaluation of the plaintiff's personal value, and insulting the plaintiff by expressing that the plaintiff
Furthermore, with respect to the amount of consolation money, comprehensively taking account of all the circumstances revealed in the arguments of this case, such as the health team, the background leading up to the Defendant’s preparing each of the instant comments, the content of each of the instant comments, the circumstances following the preparation of each of the instant comments, the Defendant’s attitude, the degree of suffering suffered by the Plaintiff due to each of the instant comments, and other factors, such as the respective ages, occupations, and social status of the Plaintiff and the Defendant.
