Defendant shall be punished by a fine of 6 million won.

If the defendant does not pay the above fine, the amount of KRW 100,000 shall be paid.

Punishment of the crime

Defendant

A is an owner who newly constructs multi-family housing of a size of 494.66m2 in the total floor area of 494m2 in Sungsung City.

1. Where a person who intends to construct or repair a building in violation of the Building Act (large-scale repair and extension without permission) and a person who intends to expand a multi-household house with at least three floors is at least 1/10 of the total floor area of the building, he/she shall obtain permission from the competent administrative agency;

Nevertheless, from November 2015 to November 201 of the same year, the Defendant extended the building of a separate entrance, toilet, main boiler, etc. to 3 households from 2nd floor, 3 households from 3rd floor to 2nd household from 4th floor, and 2 households from 4th floor to 3rd household from 4th floor by installing a separate entrance and a bearing wall on the above multi-household housing, and extended the building by installing a separate entrance, toilet, main boiler, etc. to 114 square meters from 5th floor (14 square meters in total floor area).

2. A person who intends to construct or install multi-household housing in an urban area under the National Land Planning and Utilization Act in violation of the Parking Lot Act shall install a parking lot inside such facilities or on the site thereof.

Nevertheless, Defendant 1 installed a separate entrance and bearing wall on the second, third, and fourth floor of multi-household housing as set forth in the above 1.1., and installed a separate entrance and a toilet, kitchen, boiler, etc. and extended one household in the 5th floor, but did not install three parking lots (7 parking lots attached thereto) in the said multi-household housing.
