A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

In using and managing access media, no person shall borrow or lend, keep, deliver or distribute access media with the knowledge that such media is to be used for a crime or to be used for a crime.

피고인은 2018. 4. 경 ‘D’ 이라는 중국 사이트의 구인 ㆍ 구직 코너에서 ‘ 퀵 서비스 사원을 모집한다’ 는 게시 글을 보고 위 챗 대화명 ‘E ’를 사용하는 불상자를 알게 되었고, 그로부터 ‘ 체크카드를 직접 수거하여 지정한 물품 보관소 또는 우편함에 넣어 두면 된다’, ‘ 물품보관함 비밀번호 문자가 전송되면 그 비밀번호를 나에게 알려 주면 된다’ 는 등의 지시에 따라 일을 하면 비자문제를 해결해 주고, 일당도 주겠다는 제안을 받고 이를 승낙하여, 위 불상자와 함께 접근 매체를 보관, 전달하기로 공모하였다.

1. 4. On the front day of the 1320-way “all national churches” in the 1320-way, Kimhae-si, I received 2 e-mail cards connected to I’s post office accounts (J) and new bank accounts (K) from I, and thereafter kept them in Seoul Special Metropolitan City’s non-place around that time.

Accordingly, the defendant, in collusion with the needy person, delivered and stored three copies of the physical card, which is an access medium, knowing that it will be used in the crime.

2. On May 15, 2018, in accordance with the direction of the aforementioned “E”, the collection of e-mail cards for a crime was conducted on May 15, 2018, by collecting two e-mail cards, including one e-mail card connected from M to the bank account (N) of M from M on the front side of L/C on May 15, 2018, and one e-mail card connected to P from P to the bank account (N) of P on the 19:04 on the same day.
