The defendant's appeal is dismissed.

1. The summary of the grounds for appeal stated to the effect that the instant loan certificate was forged, such as “A”. However, there was no perception that the statement was false at the time, and there was no “public performance” in the crime of defamation.

Nevertheless, the judgment of the court below which found the defendant guilty of the facts charged of this case is erroneous and adversely affected by the judgment.

2. The defendant also asserted that he is identical to the above assertion of mistake of facts, and the court below rejected the above assertion in light of the evidence duly adopted and examined by the court below. Thus, the judgment of the court below is justified, and the above argument by the defendant is without merit.

3. If so, the defendant's appeal is without merit, and it is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act. It is so decided as per Disposition.
