The defendant's appeal is dismissed.
Reasons
1. Summary of grounds for appeal;
A. misunderstanding of facts and misapprehension of legal principles cannot be readily concluded that the Defendant’s assault inflicted an injury on the victim, and even if so, the victim suffered the injury.
Even if it is extremely minor and does not constitute an injury to robbery, the attempt of robbery should be counted.
Nevertheless, the judgment of the court below which recognized the robbery injury is improper.
B. The punishment sentenced by the lower court (three years and six months of imprisonment) is too unreasonable.
2. Determination
A. Comprehensively taking account of the following circumstances acknowledged by the lower court and the evidence duly admitted and investigated in the lower court’s judgment as to the assertion of misunderstanding of facts and the legal doctrine, the Defendant could fully recognize the fact that the Defendant inflicted bodily integrity on the victim during the course of committing the robbery of this case or inflicted bodily injury on the victim to the extent that it may interfere
The judgment of the court below to this purport is just, and the defendant's above assertion is without merit.
