A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. [2012 Highest 5827] From September 14, 2012 to December 17, 2017 of the same month, the Defendant pretended to be able to pay the PC price and food cost in ordering the above victim to use the PC after paying KRW 4,000 to the above victim from around 21:37 of the same month to around 12:17 of the same month.

However, there was no money held by the defendant at the time, so there was no intention or ability to pay the price even if the PC was used or food was ordered.

As above, the Defendant, by deceiving the victim and using the PC, obtained pecuniary benefits equivalent to 14,300 won for the use of the PC from the victim, and received from the victim, 3,000 won for the use of the PC, 3,500 won for the rats, 1,000 won for the fireworks, and 7,500 won for the sum of them.

2. [Attachment 2013 Highest 4062] On May 16, 2013, the Defendant entered the victim G management HP room located in Daegu Suwon-gu from around 06:46 to around 22:40 on May 16, 2013, and carried out the Internet game.

However, the defendant did not have the intention or ability to pay the crupted fee.

As such, the Defendant acquired economic benefits equivalent to the same amount because he did not pay 39,800 won for the use of a scambling by deceiving the victim.

3. [Attachment 2013 Highest 4273] The Defendant, from May 26, 2013 to May 23:17, 2013, entered the Korea Twits for the operation of the Victim JJ on the 3th floor in Daegu-gu, Daegu-gu from around 06:05 to around 23:17.

However, the defendant did not have the intention or ability to pay the crupted fee.

As such, the Defendant acquired economic benefits equivalent to the same amount because he did not pay an amount equivalent to KRW 1,800 of the fee for the use of a scambling by deceiving the victim.
