A defendant shall be punished by imprisonment for not less than five months.

Punishment of the crime

On December 12, 2013, the Defendant was sentenced to eight months of imprisonment for fraud at the Seoul Central District Court, and completed the execution of the sentence on May 6, 2014.

[2014 Highest 6643] From August 23, 2014 to August 22:51, 2014, the Defendant acquired economic benefits equivalent to the same amount because he did not pay 39,700 won for the use fee, even if using a computer in the same place.

1. On August 5, 2014, around 02:25, the Defendant: (a) entered the victim G’s “H” room operated by the victim G of the 2nd floor F in Bupyeong-gu, Seocheon-gu, Busan; (b) obtained pecuniary benefits equivalent to the same amount because the Defendant, even if using the PC, by deceiving the victim as if he/she did not have any intent or ability to pay the PC but would have paid the fee; and (c) he/she did not pay the fee by using the PC from the victim until 19:56 on the same day.

2. On August 21, 2014, the Defendant entered the PC room managed by the victim J in Bupyeong-gu Incheon Metropolitan City as a customer on August 21, 2014 in the same manner as paragraph (1).

8. 22. 22. up to 09:15, the user fee was not paid in 10,400 won, thereby acquiring economic benefits equivalent to the same amount.

3. On August 31, 2014, around 10:30 on August 31, 2014, the Defendant: (a) entered the PC operated by the injured party M in Gangseo-gu Seoul Metropolitan L Building as a customer; (b) but used the PC by not later than 20:45 on the same day by not paying KRW 10,500 for the fee; and (c) obtained pecuniary benefits equivalent to the same amount.

4. The Defendant, around 10:26 August 27, 2014, entered the Defendant as a customer in QP room operated by the victim P on the O and the 2nd floor of Bupyeong-si, Bupyeong-gu, Busan and the second floor, and the Defendant also uses the PC.
