Reasons
Punishment of the crime
The defendant of "2014 Highest 329" is a person who operates a medical service business as a manager of the Dental Hospital Dental Hospital in Gunsan-si B.
1. The Defendant, while working in the foregoing D Hospital, did not pay KRW 1,416,60 on February 1, 2013 of BB retired on March 11, 2013, and did not pay KRW 4,852,470 on the total wages of three workers within 14 days from the date of retirement without any agreement on extension of the due date between the parties concerned.
2. Although the Defendant paid wages at least once a month on a fixed date, the Defendant did not pay wages of KRW 6,00,000 on November 2, 2013, which were employed by the said D Hospital from September 23, 2013, and wages of KRW 8,000,000 on December 2, 2013, and KRW 22 million on January 201, 2014, including wages of KRW 8,000,00 on a regular basis.
The defendant of "2014 Highest 319" is the actual owner of the CMedical Foundation D Hospital in the medical corporation located in the Si of Gunsan-si B, who is engaged in the medical service by using 23 regular workers.
1. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and all other money or valuables within fourteen days after the cause for such payment occurred;
Nevertheless, the defendant is working from April 11, 2012 to January 29, 2014 at the above workplace.
On November 2013, 2013, 200,000 won of retired workers BD, as shown in the attached list of crimes, did not pay the total of 9,460,000 won to four workers within 14 days from the date of retirement, without any agreement on extension between the parties concerned of the due date.
2. An employer who violates the Guarantee of Workers' Retirement Benefits Act shall, in case where a worker retires, pay the retirement allowance within fourteen days after the cause for such payment occurred; and
Nevertheless, the defendant is working from April 11, 2012 to January 29, 2014 at the above workplace.
