The prosecution of this case is dismissed.
Reasons
1. On August 30, 201, the Defendant: (a) received a request from the victim for the recovery of claims equivalent to KRW 29 million against D from the victim at the victim’s office located at the window B of Changwon-si, Changwon-si; and (b) again requested the Seoul Credit Assessment, etc. to collect the said claims.
1. Around October 5, 2011, the Defendant arbitrarily consumed KRW 700,000 from the Seoul Credit Rating to D for personal purposes on October 6, 201, while being transferred to the Agricultural Cooperative Account Number E in the name of the Defendant.
2. Around October 24, 2011, the Defendant, while receiving KRW 350,000 from Seoul Credit Rating to D as the Defendant’s agricultural bank passbook, arbitrarily consumed for personal purposes on the same day.
3. Around November 1, 2011, the Defendant received from the Seoul Credit Rating to transfer KRW 210,000 from the Seoul Credit Rating to the Defendant’s agricultural bank passbook, and used at will for personal purposes on the same day.
4. Around November 4, 2011, the Defendant arbitrarily consumed KRW 2,119,00 for personal use on the same day while receiving KRW 2,119,00 from the Nam Chang National Agricultural Cooperative to the Defendant’s agricultural cooperative head.
5. Around November 18, 2011, the Defendant arbitrarily consumed KRW 514,717 for personal purposes on the same day while receiving KRW 514,717 from the Hyundai Card to the Defendant’s agricultural bank.
6. On November 21, 2011, the Defendant arbitrarily consumed the amount of KRW 607,464, and KRW 4,859,185 from Samsung Card and FFC Card to the Defendant’s agricultural bank head, while keeping the amount of KRW 607,464 and KRW 4,859,185 from the Defendant’s Samsung Card and FFC Card for personal
7. On December 9, 2011, the Defendant arbitrarily consumed KRW 1,891,512 for personal purposes on the same day while receiving KRW 1,891,512 from the Hyundai Card to the Defendant’s agricultural bank.
