A defendant shall be punished by imprisonment for three years.
However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. 아동ㆍ청소년의성보호에관한법률위반(강제추행) 피고인은 2012년 8월 초순 늦은 밤 부산 해운대구 D에 있는 E 앞 부근을 배회하는 아동ㆍ청소년인 피해자 F(여, 18세) 일행을 보고 다가가 “클럽 넣어주겠다”라고 말을 걸어 인근 G클럽으로 데리고 간 적이 있고, “다음에도 클럽에 가고 싶으면 연락하라, 클럽에 넣어주겠다”라고 말하여 피해자로부터 환심을 샀다.
