1. Basic facts
A. On May 19, 2010, C established D Co., Ltd. (hereinafter “D”) and held office as its representative director. Around May 19, 2010, several unspecified investors recruited investors by advertising to the following: “In the event of purchase of real estate as D members and payment of investment money, the amount equivalent to 120% of the investment money is set up; the real estate is sold for three years and the total amount of the investment principal is repaid; up to three years, two to three% of the investment principal is paid as the activity expenses; and up to three years, 30% of the profits accumulated in the club, other real estate is paid as dividends; and a certain dividend is paid in the event of recruitment of subordinate members.”
In order to promote friendship among the members who have registered for membership in a club and to promote business activities through the club operation committee and to create profits for its members, D of the agreement on monetary transactions between the members of the club shall prepare this agreement with the intention of making the members not capable of causing any after-sales problems in trading the money between the members.
