Reasons
1. Facts of recognition;
A. Lease 1 between the Plaintiffs and E, the Plaintiffs are the real estate listed in the separate sheet (hereinafter “instant commercial building”).
2) Around June 1, 2011, F and D established E (the representative: F; hereinafter referred to as “E”) for the purpose of breabbing business, etc., and upon entering into a lease agreement with the Plaintiffs, the instant commercial building in the name of the lessee E, which is KRW 100 million, KRW 8 million per month of rent (in addition to value-added tax, KRW 10,000,000 from June 1, 201 to May 31, 2013; and thereafter, F and D entered into a lease agreement with the Plaintiffs for the purpose of breabing, etc., and operated the said commercial building in the same manner.
B. On December 3, 2012, between the Plaintiffs and the Defendant, the Defendant entered into an investment contract with the Defendant to invest KRW 300 million in E and receive a certain amount of monthly sales revenue dividends, and agreed to change the lessee’s name under a lease agreement between E and the Plaintiffs for the purpose of securing the claim for return of investment deposits. (2) On December 6, 2012, the Defendant entered into a lease agreement with the Plaintiffs for the instant commercial building from December 31, 2012 to May 31, 2013, between the Plaintiff and the Defendant and the Plaintiff to change the lessee’s name under the lease agreement between E and the Plaintiff. (3) On December 6, 2012, the Defendant entered into a lease agreement with the Plaintiffs for KRW 100 million, monthly rent (value-added tax, and KRW 100,000,000,0000 from December 6, 2012 to May 31, 2013.
3) After that, while the above lease contract was explicitly renewed between the plaintiffs and the defendant, the defendant, on February 6, 2017, deducted the lease deposit amount of KRW 50 million (50 million out of the overdue rent from the existing lease deposit to the time) with the plaintiffs on February 6, 2017.
