1. The Defendants shall jointly and severally pay to the Plaintiff KRW 40,000,000 and the interest rate thereon from April 20, 2020 to the day of full payment.

On August 19, 2019, the Plaintiff loaned interest of KRW 40,000,00 to Defendant B by setting the interest rate of KRW 18% per annum, and on November 30, 2019, and Defendant C guaranteed the above loan obligations of Defendant B. The Defendants paid interest until April 19, 2020 may be recognized either by dispute between the parties or by means of Gap evidence, Eul evidence, and Eul evidence 1 to 3.

According to the above facts, the defendants are jointly and severally liable to pay to the plaintiff the above loans of 40,000,000 won and damages for delay calculated at the rate of 18% per annum from April 20, 2020 to the date of full payment.

Therefore, the plaintiff's claim against the defendants is justified within the scope of the above recognition, and part of the claim is accepted, and the remainder is dismissed as it is without merit. It is so decided as per Disposition.
